What Is The COVID-19 Disclosure Form For Visitors?



With the ongoing Coronavirus pandemic, in California, your agent most likely sends out a COVID-19 disclosure form for you to sign before each and every showing. This is called the Coronavirus Property Entry Advisory and Declaration - Visitor (C.A.R. Form PEAD)


The COVID-19 disclosure form is intended to educate buyers and sellers about the risk of exposure to covid 19 and any associated injury or harm as a result of permitting accessing to your property. 


Below is a brief explanation of each item on the document:

Item #1 - Risk of Exposure 

It spells out that COVID 19 is a world wide pandemic and that everyone is at risk of exposure to it.


Item #2 - Government Orders 

This part talks about the "Stay at Home" order by the government and other directives limiting the activities that businesses and members of the public can engage in.


Item #3 - Visitor Advisory 

You are advised that if you engage in activities prohibited by the COVID-19 Directives, you are acting against the advise of your broker. Agents are to comply with the safe COVID-19 practices and you are required to take reasonable steps necessary to protect yourself and others. 


Item #4 - Purpose of Entry 

Explains the purpose of the entry is for performing activities or providing services for the facilitation of real estate transaction. 


Item #5 - Property Entrant Rule 

It outlines the "Posted Rules of Entry". You are voluntarily entering the property and agrees to take all necessary and reasonable precaution to prevent the spread of COVID-19.


Item #6 - Signer Acknowledgement and Authorization 

No written marketing materials will be at the property. The "Posted Rules of Entry" will be posted at the entrance of the property for all to see. Signer agrees that even though others have been advised to clean and disinfect the property before and after every showing, there is no guarantee that any or all instances of  COVID-19 has been removed. Signer has been provided an electronic copy of the Mandatory Government Showing Requirements, including Best Practices Guidelines and Prevention Plan. Signer can obtain online information about COVID-19 Directives from the California Department of Public Health (CDPH) and Industrial Relations (CalOsha).


Item #7 - Singer Representation 

This item points out that accessing property for the purpose mentioned above, may be dangerous and unsafe and could expose you or others to COVID-19 and that you are voluntarily accessing the property. You are signing that to the best of your knowledge, in the last 14 days, you have not been in contact with anyone with someone with COVID-19 and that you yourself are currently not afflicted. It states that you are not currently experiencing symptoms associated with COVID-19. It also explains that any person with COVID-19 may not show symptoms, not be aware that they are afflicted and may not voluntarily agree to disclose their condition. In bold letters, you are to inform broker if anything changes to your health condition after signing this form.


Item #8 - Accompanying Minors 

Adult signers acknowledges that the same rules and disclosure apply to minors. You, as an adult, are responsible for the safety, care and conduct of minors touring the property with you. 


Item #9 - Exceptions to Representations and Additional Terms 

Here you will find additional terms not prewritten on this form.


Item #10 - Agreement, Declaration and Assumption of Risk 

By signing, you are declaring that your statement is true, that you agree to take all recommendation and reasonable actions to protect you and others from exposure to COVID-19 and that YOU ASSUME THE RISK when entering the property. 

Again, in bold letters, you understand and agree that no one, including but not limited to real estate brokers and agents, can guarantee that you will not be exposed or contract COVID-19


By signing the document, you acknowledge that you have read, understand, voluntarily agree to the foregoing and will adhere to the Posted Rules of Entry, and have received copy of the document.


A document attached to the disclosure is the Mandatory Government Showing Requirements, including Best Practices Guidelines and Prevention Plan. It outlines the following:


  1. Showing Rules for Listing and Buyer's Agents
  2. Cleaning and Disinfecting the Property and Sanitation Products
  3. Rules for Every Visitor
  4. Rules for Seller
